Wrongful Death

The decedent was walking on the shoulder of the highway when a pickup truck swerved off the highway and struck him. The defendant alleged that another vehicle cut him off and he swerved to avoid being struck by the other vehicle. The defendant struck the decedent traveling approximately 60 mph and the decedent died on the scene.

Allstate insured the defendant and originally denied liability. The family hired our firm to investigate and pursue a wrongful death and survival cause of action. Mr. Wooley investigated the collision using accident reconstruction. He then used this data and issued a Stowers demand to the defendant.  Allstate quickly offered its policy limits. Our firm then found additional coverage and collect its policy limits as well.
