Our client had two prior back surgeries. She was driving near I-35 in Waco, Texas. She had a green light and proceeded into the intersection. Another driver ran a red light and struck her vehicle.  The collision aggravated her prior back injuries.  The other driver was insured by GEICO. GEICO claimed her injuries were unrelated to the car wreck and only offered $8,784.04. We filed suit and settled the case for $57,514.20. Our clients were traveling to work in the HOV on 635 in northeast Dallas when a driver tried to cut into the HOV over the white pickets and collided with our clients’ vehicle. Luckily, our clients only suffered soft tissue injuries. The other driver was insured by Allstate. Allstate’s top offer was $3,506 for the driver and $3,275 for the passenger.  At trial, the jury awarded $53,735 to the driver and $12,842.12 to the passenger. Wrongful Death

The decedent was walking on the shoulder of the highway when a pickup truck swerved off the highway and struck him. The defendant alleged that another vehicle cut him off and he swerved to avoid being struck by the other vehicle. The defendant struck the decedent traveling approximately 60 mph and the decedent died on the scene.

Allstate insured the defendant and originally denied liability. The family hired our firm to investigate and pursue a wrongful death and survival cause of action. Mr. Wooley investigated the collision using accident reconstruction. He then used this data and issued a Stowers demand to the defendant.  Allstate quickly offered its policy limits. Our firm then found additional coverage and collect its policy limits as well.
